Agreement: By renting a golf cart from Carritos Colibrí (“Renter”) agrees to be bound by these Terms and Conditions.
Rental Requirements: Renter must be at least 18 years of age and possess a valid driver’s license. Renter agrees to provide accurate and complete information during the reservation and rental process.
Rental Period: You will have the benefit of the cart for the period stipulated in this agreement. We may extend the period in this agreement if you inform us at least 24 hours before the established return date and if we accept your request.
We reserve the right to reclaim our cart before the established return date if we believe that you have provided us with any false information or we find that you are being reckless with the cart.
Rental Rates and Charges: Renter agrees to pay the rental rates, charges, and fees as specified in the reservation or as communicated by Carritos Colibrí.
Use of Golf Cart: Only drivers stipulated in this contract can drive the cart and must have a valid driver’s license. Renter is responsible for maintaining the golf cart in the same condition as at the start of the rental period. Renter agrees to use the golf cart in a safe and responsible manner, obeying all applicable laws and regulations. The golf cart shall not be used for any illegal or prohibited purpose, including but not limited to off-road use, racing, towing, or transportation of passengers or cargo beyond the designated seating or storage capacity of the golf cart. It is forbidden to drive the cart under the influence of alcohol or drugs, on slopes with more than 20 degrees of inclination and to exceed the number of 4 passengers. If the cart breaks or breaks down for any of these reasons, the person named as the “renter” in this contract is responsible for the repair and repair costs.
What to do if you have an accident or the Cart is Stolen
If you are involved in a traffic accident, you must wait for the arrival of the police. Do not admit to being at fault before they arrive.
You will have to collect the names and addresses of anyone involved in the accident, including witnesses, You will also need to make sure the cart is safe and report to the police any injured persons. And then contact us. If the cart has been stolen, contact us as soon as possible. Carritos Colibrí has installed a tracking device in the Cart for safety and loss prevention.
Force Majeure: Carritos Colibri shall not be liable for any delay, failure, or disruption in the performance of its obligations under these Terms and Conditions due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, lockouts, riots, acts of war, terrorism, or governmental actions.
Breakdowns and Replacement: Our golf carts, purchased in 2023, undergo a full technical revision in Tamarindo every 3-6 months to ensure their optimal performance and your safety. However, in the unlikely situation that your Cart from Carritos Colibrí breaks down, we will do our best to provide a replacement cart during the repair period. If a replacement cart is unavailable, you have two options:
- Receive a partial refund of $50 per day for each day the cart is unavailable during repair.
- Opt for a full refund for all unused days remaining in the contract. The refund amount will be prorated based on your initial rental payment.
Kindly be aware that weekend repairs are not possible due to the closure of mechanic offices during that time.
Liability: Renter assumes all risks and liabilities associated with the use of the golf cart, including but not limited to injuries, damages, or losses to Renter, passengers, third parties, or property during the rental period. Carritos Colibri shall not be liable for any damages or losses arising from the use of the golf cart, except as required by law.
Indemnity: Renter agrees to indemnify and hold harmless Carritos Colibrí , its affiliates, employees, and agents from and against any claims, damages, losses, or expenses arising from Renter’s use of the golf cart, including but not limited to any breach of these Terms and Conditions.
Governing Law and Jurisdiction: These Terms and Conditions shall be governed by and construed in accordance with the laws of Costa Rica. Any disputes arising out of or in connection with these Terms and Conditions shall be resolved exclusively in the courts of Costa Rica.
Waiver: The failure of Carritos Colibrí to enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed to in writing by Carritos Colibri.
Reservation of Rights: Carritos Colibrí reserves the right to refuse or cancel any reservation or rental without prior notice, and to take appropriate legal action for any violation of these Terms and Conditions or any applicable laws or regulations.
